Are you considering adding a pool or spa to your dwelling? To sell or lease your property with a swimming pool or spa, the owner must have a Certificate of Compliance, a Certificate of non-compliance or an Occupation Certificate for the pool.
Swimming Pools Act 1992
In 2013, the New South Wales Government reviewed and amended the Swimming Pools Act 1992, which now requires all swimming pools and spas to be registered.
From 2016, a valid compliance or non-compliance certificate must be issued before the property is sold. A Sydney pool certificate is issued after the swimming pool or spa has been inspected by qualified Sydney swimming pool and fence certifiers such as the experts at Home Certs.

Requirements for Sydney pool and fence safety inspections and certification
The new law applies to all kinds of swimming pools and spas including in-ground, above-ground, indoor, portable and other vessels that can be filled with 300mm of water or more. Bathroom spas that are emptied after use are not included.

Getting your Sydney Swimming Pool Compliance Certificate
If your pool or spa is found to be non-compliant with new laws, we will advise you exactly how to resolve any such issues. Once rectified, you will be eligible to receive a compliance certificate which becomes part of your contract of sale or lease for your property.
You can also market and sell your property with a non- compliance certificate, where the buyer fixes any issues to achieve compliance. A Certificate of Compliance is valid for three years, after which time, your pool will need to be re-inspected and re-certified.
